Terms of Service
These Terms of Service ("Terms") govern your use of QuestBourne (the "App"). The App is run by Ernests Pulks, an individual based in Latvia, European Union ("we", "us"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Who can use QuestBourne
You must be at least 16 years old to use the App. By using it, you confirm that you meet this requirement and that the information you provide is accurate.
2. What QuestBourne is
QuestBourne is a self-improvement and habit-building app. You set goals ("missions") in four areas of life, and the App uses artificial intelligence to suggest small daily actions ("quests"), short teaching notes ("lessons"), step-by-step plans ("roadmaps"), and feedback on what you write. It is a general motivational and educational tool, nothing more.
3. AI-generated content
Quests, lessons, roadmaps, explanations, answers to your questions, and feedback in the App are generated by artificial intelligence. AI can be wrong. This content may be inaccurate, incomplete, outdated, or unsuitable for your specific situation, even when it sounds confident and specific.
Always use your own judgment, and adapt or ignore any suggestion that does not fit you. Do not rely on the App as a source of factual, professional, or authoritative information.
4. Not professional advice
QuestBourne does not provide medical, health, fitness, nutritional, dietary, psychological, mental-health, financial, investment, tax, or legal advice, and nothing in the App is a substitute for a qualified professional. The App suggests; it does not advise.
- Consult a qualified physician or health professional before starting any exercise, diet, weight-loss, fasting, or wellness program, and about any medical, mental-health, allergy, or dietary concern.
- Consult a licensed financial or legal professional before making any financial, debt, savings, investment, or legal decision.
- Weight and other health targets you set are your own. The App may decline a target that looks unsafe, but it does not check that any target or quest is safe for you.
If you are in crisis or think you may be experiencing a medical or mental-health emergency, contact your local emergency services or a professional immediately. The App is not an emergency or crisis service.
5. Physical activity and assumption of risk
Some quests may suggest physical activity, exercise, food changes, or skill practice. These carry an inherent risk of injury or harm. You undertake any such activity entirely at your own risk. You are solely responsible for judging whether an activity is safe and appropriate for your fitness, health, ability, and environment, for using proper technique and equipment, and for stopping if anything feels unsafe. Do not attempt anything beyond your ability.
6. Your responsibility
You are responsible for the decisions you make and the actions you take, including those influenced by the App. You use the App voluntarily, and any outcome of following (or not following) its suggestions is your own responsibility.
7. Your account
You can sign in with an email address and password, with Sign in with Apple, or with Sign in with Google. You are responsible for keeping your login details and your device secure, and for activity under your account. Provide accurate information, and do not use the App for any unlawful, harmful, abusive, or fraudulent purpose, or in a way that interferes with its operation or other users.
8. Tribe and usernames
Everyone gets an @username. Other users can find you by searching it, or through your invite link, and add you to their Tribe without asking first. Anyone who has added you can see your username, @username, character, streaks, quest and XP counts, badge count, and whether you have a subscription. They cannot see your goals, quests, notes, or anything you write.
You can make your profile private in Settings, so nobody can find you in search or add you by @username; your invite link still works. You can block anyone, which removes them from your Tribe and stops them seeing, finding or adding you, and you can unblock them in Settings. You can report a username from the person's card.
Choose a username that is not offensive, hateful, sexual, misleading, or someone else's name or trademark. We do not tolerate objectionable content or abusive users. We review every report, and we may change or remove a username, or close an account, that breaks this rule.
9. Subscriptions and payments
Some features need a paid subscription. In the iPhone app, subscriptions are bought through Apple's App Store and are also subject to Apple's terms.
- The price and length of each subscription are shown before you buy.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Payment is charged to your Apple ID.
- A free trial turns into a paid subscription when it ends unless you cancel before then. One free trial is available per email address.
- You can manage or cancel your subscription in your Apple ID settings. Deleting the App or your account does not cancel it.
- Refunds are handled by Apple under Apple's policies. By starting a subscription you ask for immediate access to the paid features, and you acknowledge that this may affect your EU 14-day right of withdrawal, as far as the law allows.
10. Intellectual property
The App, its design, and its content (excluding content you create) belong to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use. You keep ownership of what you write in the App, and you let us store and process it only to run the App for you.
11. Apple
If you use the App on an Apple device, Apple's Licensed Application End User License Agreement also applies. These Terms are between you and us, not Apple. Apple is not responsible for the App, its content, maintenance, support, warranty, or any claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
12. Disclaimer of warranties
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or that the App will be uninterrupted, secure, or error-free. Some countries do not allow certain warranty exclusions, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss (including physical injury, financial loss, or loss of data) arising from your use of, or reliance on, the App or its AI-generated content. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid for the App in the 12 months before the claim, or EUR 50.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, for intentional or grossly negligent conduct, or any other liability that cannot be limited by law, and nothing here affects your mandatory rights as a consumer.
14. Indemnity
You agree to indemnify us against claims, losses, and expenses arising out of your breach of these Terms or your misuse of the App, to the extent permitted by law.
15. Changes, suspension, and ending your account
We may update these Terms from time to time. If a change is significant, we will tell you in the App or by email before it applies, and the "Last updated" date will change. If you keep using the App after that, you accept the update; if you do not accept it, you can stop using the App and delete your account.
We may suspend or end your access if you seriously or repeatedly breach these Terms. We may also change or stop offering the App; if we stop it completely, we will give reasonable notice where we can. You can delete your account at any time in Settings.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Latvia. If you live in the EU or in another country with mandatory consumer-protection laws, you keep the protection of those laws and may bring a claim in the courts where you live.
17. General
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right straight away, we have not given it up. These Terms and the Privacy Policy are the whole agreement between you and us about the App.
